US Parcel Delivery Company Faces Class-Action Lawsuits Amidst Tariff Refund Disputes
The recent US Supreme Court decision has left FedEx with a mountain of unsettled refund claims from its customers, who are now taking the shipping giant to court. In May, the high court ruled that FedEx’s practice of not offering refunds for tariffs on international packages was in direct contravention of federal law. As a result, thousands of FedEx customers have filed class-action lawsuits against the company, seeking compensation for the charges they were forced to pay despite having had them waived by US customs. The plaintiffs argue that FedEx should be required to provide full refunds for all tariffs imposed on their packages during the Trump administration’s trade war with China. The lawsuit, which is one of several pending against FedEx, centers around a 2020 ruling by the Consumer Financial Protection Bureau (CFPB) that exempted package delivery companies like FedEx from certain regulations governing tariffs. However, the US Supreme Court’s reversal in May has thrown the entire matter into question. FedEx officials have maintained that the company did comply with all relevant laws and regulations regarding tariff refunds but acknowledge that its earlier practice of not offering refunds was “inadequate”. The shipping giant is currently working to resolve the outstanding refund claims on an individual basis, while also facing potential fines from regulatory agencies if it fails to provide adequate compensation. Industry analysts note that FedEx’s exposure to additional litigation costs could lead to a significant financial impact in the coming years. As such, it will be interesting to watch how this issue unfolds and whether other shipping companies are similarly affected by the US Supreme Court’s ruling.
