Elon Musk Testifies in Landmark Trial Against Sam Altman and OpenAI
In a California federal court, Elon Musk testified for the second day of a highly publicized trial against Sam Altman, co-founder of OpenAI. The trial centers on OpenAI’s 2015 founding as a nonprofit organization with the goal of benefiting humanity. Musk, who invested approximately $38 million in the company between 2015 and 2017, claims that he lost confidence in Altman’s commitment to maintaining the company’s nonprofit mission.
Musk stated that by late 2022, he was concerned that Altman was attempting to “steal the charity” and alleged that this concern proved true. However, OpenAI’s lawyers disputed Musk’s claims, stating that there was never a formal commitment to remain a nonprofit organization. Instead, they argued that the company created a for-profit arm as part of efforts to fund its computing power ambitions and attract talent.
OpenAI is set to undergo an initial public offering (IPO) that could value it at $1 trillion, according to Reuters. Musk’s lawsuit seeks $150 billion in damages from OpenAI and Microsoft, with any award directed towards OpenAI’s charitable arm. He also requests the court to force OpenAI to return to its nonprofit status and remove Altman and co-founder Greg Brockman from leadership.
Musk’s lawyers have accused OpenAI of attempting to undermine his competing venture, xAI, which trails OpenAI in user adoption. The trial is ongoing, with both parties presenting their cases.
