FCC Issues Notice to Broadcasters Over Free Speech Concerns

US Media Regulation Sparks Concerns Over Freedom of Speech

A recent development in US media regulation has raised concerns about the potential curtailing of speech and media freedom. In November 2024, Kamala Harris appeared on ABC’s daytime show, The View, where she was asked if she would do anything differently from President Joe Biden. Harris stated that there was nothing she would change, which some analysts saw as a strategic move to tie herself to the economic hardships faced by voters during the Biden administration.

The incident has sparked debate about equal access to airtime for political candidates. The US Communications Act requires daytime and late-night shows to provide equal opportunities to all candidates running for office. However, some shows may claim exemption under the guise of being “bona fide news” programs.

In January 2024, the Federal Communications Commission (FCC) issued a public notice stating that concerns had been raised about the exemptions granted to daytime and late-night shows. The FCC emphasized that these shows are not exempt from providing equal access to all candidates. However, critics argue that this process could be used as a tool for harassment and intimidation.

Harold Field, senior vice president at Public Knowledge, stated that broadcasters may begin to rethink which perspectives to air and which ones not to. Seth Stern, chief of advocacy at the Freedom of Press Foundation, noted that the notice could lead to censorship. Gigi Sohn, a lawyer who has previously worked in the FCC, expressed concerns about how the notice would be applied.

The issue stems from the Communications Act of 1934, which requires broadcasters to provide equal time to all candidates running for office if they are given airtime. The FCC’s recent actions have sparked debate about the balance between media freedom and regulation.
