A US Court of Appeals Ruling on Military Policy
A divided three-judge panel of the US appeals court for the District of Columbia has issued a ruling on a policy implemented by the Trump administration regarding transgender individuals in the military. The policy, which was introduced as part of President Donald Trump’s “Prioritizing Military Excellence and Readiness” executive order, prohibits transgender people from enlisting in the military.
The court’s decision was split, with one judge upholding a lower court ruling that rejected the policy as it pertains to already enlisted service members. Another judge agreed with this opinion but extended its scope to include those who seek to enlist. The third judge issued a dissenting opinion, questioning the court’s authority to review military policy.
The policy in question was introduced by Trump on January 27, 2025, and states that transgender individuals are unfit for service due to their “false ‘gender identity’”. The policy has been challenged by several plaintiffs who have argued that it is discriminatory. In Monday’s ruling, one judge described the policy as “blatantly discriminatory” and stated that it appears to be driven by a desire to harm a politically unpopular group.
The court’s decision strikes down part of a lower court injunction that had barred the Trump administration from banning transgender people from enlisting in the military. The ruling allows the Trump administration to continue enforcing its policy, but with some limitations.
