The Justice Department has filed motions to dismiss the criminal cases against Steve Bannon, a former advisor to President Donald Trump. The department is seeking to have Bannon’s convictions for defying subpoenas from the House Select Committee investigating the January 6th US Capitol attack dropped.

Bannon was subpoenaed by the committee in May 2022, but he refused to comply, citing his Fifth Amendment right against self-incrimination. He was subsequently charged with contempt of Congress and faces up to six months in prison if convicted.

The Justice Department has filed motions in three separate cases related to Bannon’s refusal to testify before the committee. In one case, the department is seeking to dismiss a charge of contempt of Congress for refusing to comply with a subpoena. In another case, the department is moving to dismiss a charge of lying under oath for allegedly providing false information about his involvement in the January 6th attack.

In a third case, the Justice Department has filed a motion to dismiss Bannon’s criminal case altogether, citing that the committee’s investigation was not a “criminal prosecution” and therefore did not trigger the Fifth Amendment protection. The department is seeking to have Bannon’s convictions for contempt of Congress dropped.

The moves come as Bannon is set to appear before the US Supreme Court in a separate case related to his refusal to testify before the committee.
