The case stems from an incident in 2017 when Charles “Chaz” Littlejohn, a government contractor, stole copies of Trump’s tax returns while working on IRS files. The leaked tax returns revealed that Trump had paid no income taxes in 10 out of 15 preceding years. Trump has since filed a lawsuit arguing that he and his businesses suffered significant harm from the leaks.

The Justice Department is part of the executive branch, which raises concerns about potential conflicts of interest if Trump were to negotiate with it over the settlement. Critics have pointed out flaws in the lawsuit, including an incorrect calculation of damages based on media references rather than unauthorized disclosures by government employees. Additionally, Littlejohn’s employment status as a contractor and not a government employee has been questioned.

The case is subject to a two-year statute of limitations, which Trump claims he did not discover the violations until January 29, 2024. However, critics argue that Trump had publicly expressed concerns about his tax information being “illegally obtained” as far back as 2020.
