US Customs and Border Protection Launches Refund System for Illegally Collected Tariffs
The US government has activated a refund system, allowing importers to recover up to $166 billion in tariffs that were collected on 53 million shipments of imported goods. The system, created by CBP, is designed to process refunds for companies that paid the tariffs under a court order.
As of Monday morning, thousands of companies began filing claims through the new system. Jay Foreman, CEO of Basic Fun, reported that his company had a team ready to start uploading files as soon as the system went live at 8am US Eastern time. Despite initial concerns about the system’s durability, Foreman stated that it has been functioning relatively smoothly so far.
According to CBP, over 56,497 importers have completed the necessary steps to receive electronic refunds, totaling $127 billion. The agency expects to process refunds in phases, focusing first on more recent tariff payments. However, technical factors and procedural issues may delay an importer’s application, which could impact the timing of reimbursements.
The refund system is part of a court order that struck down tariffs imposed by President Donald Trump under a law meant for use in national emergencies. The US Supreme Court ruled in February, handing the Republican president a defeat. Companies must submit declarations listing the goods on which they collectively paid billions of dollars towards import taxes to be eligible for refunds.
CBP has stated that it created a system designed to efficiently process refunds for importers and brokers who paid the duties. The agency will issue refunds within 60-90 days if a claim is approved.
