Nintendo Sues US Government for Tariff Refund
A federal lawsuit has been filed by Nintendo of America against the US government, seeking a “prompt refund, with interest” of any duties paid as a result of President Trump’s illegally imposed tariffs on imported goods. The Supreme Court had previously ruled that Trump’s use of the International Emergency Economic Powers Act (IEEPA) to levy “reciprocal” tariffs was unconstitutional. However, it did not provide clear guidance on how refunds would be handled. Nintendo is seeking compensation for the duties paid on its Switch consoles and other imported goods, which were imposed by the US government in response to alleged unfair trade practices by other countries. The lawsuit comes as Nintendo prepares to launch its new Switch 2 console, with a planned preorder date of April 9th. The company’s move suggests that it is seeking to mitigate any potential losses caused by the tariffs, and is taking proactive steps to protect its business interests.
