FBI Agents File Lawsuit Over Alleged Retaliatory Firing After Trump Investigation

Three Former FBI Agents File Class-Action Lawsuit Over Wrongful Termination

A class-action lawsuit has been filed by three former agents of the Federal Bureau of Investigation (FBI) alleging they were wrongfully terminated from their jobs. The lawsuit, filed on Tuesday, marks the latest legal challenge against efforts to purge staff at the federal law enforcement agency.

The plaintiffs, Michelle Ball, Jamie Garman, and Blaire Toleman, claim that their employment was terminated as a result of their work on an investigation into former President Donald Trump’s efforts to stay in power after losing the 2020 election. The investigation was led by special counsel Jack Smith, who is now investigating Trump’s actions.

The three agents argue that they were abruptly fired in October and November without due process or evidence of political bias. They claim that their termination letters, signed by FBI Director Kash Patel, falsely accused them of “weaponizing” their positions within the government.

Each of the former agents had between eight and 14 years of experience at the FBI. The lawsuit explains that they were assigned to provide support to Smith’s investigation, which led to Trump’s indictment in 2023 on charges related to his actions after the election.

The Department of Justice has an internal policy prohibiting the prosecution of sitting presidents, but Trump has faced criticism for allegedly seeking retribution against employees involved in policies he disagrees with. The lawsuit asserts that President Trump made clear that top officials in federal law enforcement should carry out his retribution upon his return to office.

A group of 12 former FBI workers also sued the agency in December, alleging they were wrongfully terminated for taking a knee during a Black Lives Matter protest in 2020.
