Federal Judge Rejects Bidens Request to Withhold Memoir Recordings

US District Judge Dabney Friedrich has ruled in favor of the Heritage Foundation, a right-wing think tank, allowing them to receive recordings made by former US President Joe Biden for a memoir while he was out of office. The recordings were made with Biden’s ghostwriter, Mark Zwonitzer, and were previously authorized for release by the Trump administration.

Biden had petitioned the court for an injunction to prevent the Heritage Foundation from receiving the documents through a Freedom of Information Act (FOIA) request, arguing that releasing the recordings would violate his right to privacy. However, Judge Friedrich denied this request, stating that while Biden’s reputation may be damaged by the release of the recordings, such harm is not irreparable and does not supersede the public interest in releasing the files.

The recordings were obtained by the Justice Department as part of an investigation into alleged mishandling of classified documents by Biden while out of office. The investigation was led by special counsel Robert Hur, who concluded that no criminal charges were warranted against Biden due to a lack of evidence and concerns about jurors’ perceptions of his age and memory.

The ruling comes after Biden’s 2024 presidential campaign, during which he faced scrutiny over his age and mental acuity. Trump had previously cited Biden’s age as a factor in his decision not to seek re-election. The court’s decision allows the Heritage Foundation to proceed with releasing the recordings, which were part of a memoir released by Biden in 2017.

In her ruling, Judge Friedrich noted that while Biden has identified no public harm that would arise from the release of the recordings, she concluded that the public interest in releasing the files outweighs his diminished privacy interests.
