US Intervention in Venezuela Exposes UN Charter System Weaknesses
A recent US military intervention in Venezuela has highlighted the erosion of international law and the UN Charter system. Richard Falk, a professor emeritus at Princeton University and former UN Special Rapporteur on Palestinian human rights, notes that the attack should be viewed as part of a broader shift towards “nihilistic geopolitics” where international law is subordinated to imperial management.
The US action has significant implications for Venezuela’s sovereignty and the global security system. The intervention exposes a system in which legality is selectively invoked, veto power substitutes for accountability, and coercion replaces consent. The UN Charter’s core norm on non-interference in state affairs (Article 2(4)) was clearly violated by the US.
The lead-up to the intervention involved years of US sanctions, explicit threats, and recent lethal attacks on vessels allegedly transporting drugs. Additionally, US Special Forces captured Venezuela’s head of state and his wife, subjecting them to charges in a US federal court. This unilateral action disregarded sovereign immunity and was further complicated by President Trump’s declaration that the US would direct Venezuelan policymaking for an indefinite period.
The implications of this drastic reversal of the US Good Neighbour Policy, established since 1933, are significant. The attack on Venezuela has undermined confidence in the UN system’s ability to restrain aggression, prevent genocide, or uphold core legal norms. The use of force by the US exposes a system where legality is invoked selectively and coercion replaces consent.
The intervention has also led to the unexpected installation of Vice President Delcy Rodriguez as Venezuela’s new president, bypassing Maria Corina Machado, who had been favored by the US. This development highlights the complexities of international relations and the challenges faced by the global security system in maintaining order and upholding the rule of law.
The incident serves as a reminder that the UN Charter’s provisions are not always upheld, and that the use of force can have far-reaching consequences for international relations and global stability.
