US Supreme Court Temporarily Reinstates Telehealth Access to Mifepristone for One Week
The US Supreme Court has issued an interim order temporarily reinstating a rule allowing an abortion pill to be prescribed through telemedicine and dispensed through the mail. The decision, made by Justice Samuel Alito, pauses a lower court’s ruling that had narrowed access to the medication nationwide.
A challenge to this rule was filed by the state of Louisiana, which sought to reimpose an older federal requirement for in-person clinician visits to receive mifepristone. However, the Supreme Court has granted an administrative stay, giving itself more time to review emergency requests from two manufacturers of mifepristone.
The court’s action comes as part of a broader legal challenge to access to mifepristone, which is taken with another drug called misoprostol to perform medication abortions. The FDA had previously approved the use of mifepristone in 2000, and it has become a widely used method for abortion.
The Supreme Court’s decision follows its 2022 ruling that overturned Roe v Wade, which had established a constitutional right to abortion nationwide. Since then, several states have enacted near-total bans on the procedure, while others have restricted access.
In this case, Louisiana sued the FDA last year, claiming that a rule adopted during the Biden administration was illegal and undermined the state’s abortion ban. The manufacturers of mifepristone intervened in the litigation to defend the 2023 regulation.
The Supreme Court’s decision has been welcomed by some groups, including the American Civil Liberties Union (ACLU), which called it a “positive short-term development”. However, the court’s ultimate decision on this issue remains uncertain.
