Utah Judge Holds Prosecutors in Contempt Over Comments on Case
A Utah judge has ruled that prosecutors made comments about the Charlie Kirk murder case that violate court rules governing outside discussions of the case. On Friday, Judge Tony Graf held Deputy Utah County Attorney Christopher Ballard in contempt for making public statements about the ballistics evidence and the prosecution’s case against defendant Tyler Robinson.
The comments were made during a “media tour” by Ballard to address misinformation about preliminary findings by ballistics experts. The experts’ initial tests did not match the bullet fragment with a gun that investigators believe was used to kill Kirk. Ballard stated that he was trying to correct misinformation and provide clarity on the case, but Graf ruled that his comments went too far.
Graf denied a defence request to remove the death penalty as a sanction for the violation, instead suggesting that the issue could be resolved through the screening and questioning process for potential jurors. The judge emphasized that his ruling is aimed at enforcing court rules governing attorney conduct, not at addressing the charges against Robinson.
Robinson, 23, has not yet entered a plea in connection with Kirk’s assassination on September 10. Authorities have stated that DNA evidence consistent with Robinson’s was found on various items related to the crime scene. The case is ongoing, and both sides are working to ensure a fair trial.
