US Department of Justice Intervenes in NAACP Lawsuit Over Data Centre Environmental Impact
The US Department of Justice has filed a court motion to dismiss a lawsuit filed by the National Association for the Advancement of Colored People (NAACP) against xAI, a subsidiary of Elon Musk’s SpaceX. The lawsuit alleges that xAI illegally operated dozens of natural gas turbines at a facility in Mississippi, which powers the Colossus 2 data centre in Tennessee.
The NAACP claims that the turbines were erected without necessary permits, exposing hundreds of thousands of residents to harmful pollutants linked to various health problems. The group also notes that a larger share of residents are Black compared to the US general population.
In its motion, the Justice Department argues that the lawsuit threatens “national, economic, and energy security” by seeking to shut off the power supply for artificial intelligence innovation that supports military operations. The department claims that the US Constitution vests the power to seek civil penalties in the executive branch, including the discretion to decide when enforcement actions are unwarranted.
xAI has not responded to a request for comment. Earthjustice, an advocacy group representing the NAACP, condemned the intervention as a “massive power grab” by President Donald Trump’s administration. The group argues that the lawsuit is seeking to hold polluters accountable and protect the health of Black communities.
The Trump administration has cultivated close ties with Musk, who is also the world’s richest man. The Pentagon has used xAI’s AI model Grok in its drive to become an “AI-enabled fighting force”. If Grok cannot be deployed due to energy supply limitations, numerous tools used by the Pentagon would be severely impacted.
The US District Court will review the motion and consider the NAACP’s lawsuit against xAI.
